Wills, probate and notary services

Nearly everyone has thought of making a will at some point but only 30 per cent of us have actually done so. Even the most sensible of us often wrongly assume that making a will is something that can be put off till tomorrow.

Unfortunately the absence of a will, or a poorly written document, can mean instructions on how your estate should be dealt with are unclear and lack legal standing. This can lead to disputes over property, belongings and finance.

Here at Riley Hayes Solicitors we offer an expert yet competitively priced will writing service specifically tailored to the client’s individual circumstances and requirements. We can also advise on basic tax planning and setting up trusts.

Our long-established probate team understand how upsetting it is when a loved one passes away. This is often exacerbated by the responsibilities of having to administrator an estate. It is our aim to assist you through this time by making every step of the way as straightforward as possible.

We offer professional but sensitive guidance. Our service begins as soon as you need us and can include funeral arrangements, notifying banks and other relevant parties, calculating the IHT, applying for and obtaining the Grant of Probate, preparation of estate accounts and distributing the estate.

Power of attorney

Life is full of uncertainties and to protect you from these it is a good idea to set up a Power of Attorney.

One option is an Ordinary Power of Attorney, which gives someone else the power to handle your financial affairs for you while you are able to oversee them and make your own decisions. The other option is to set up a Lasting Power of Attorney (LPA) to give someone the authority to make decisions on your behalf should you lose the ability to do so. This person is known as an attorney, while the person who makes the Lasting Power of Attorney is called the donor.

Whichever option is best for you, we can advise and prepare applications. We also deal with Deputy Applications to the Court of Protection.

Call or contact us and speak to one of our dedicated wills and probate solicitors. We are happy to arrange home and hospital visits for those who are unable attend our offices.

Notarial services

Notarial services are a distinct element of the legal service in the UK and with the continuing trend towards globalisation and individual mobility the role of English notaries is expanding. A notary public is a specially qualified individual authorised to verify and authenticate documents for use abroad. Riley Hayes Solicitors is pleased to be able to offer a full range of services through our notaries public.

Documents and situations that often require notarisation include the following:

  • Individual powers of attorney, particularly those related to sale and purchase of foreign property
  • Corporate powers of attorney from English companies
  • Issuing good standing certificates for English companies
  • Establishment of foreign subsidiaries by English companies
  • Obtaining certified copies of passports and educational qualifications
  • Statutory declarations and affidavits
  • Opening of foreign bank accounts, for both individuals and companies

Legalisation Services

An Apostille Certificate is normally requested by foreign authorities and organisations so that your document can be used for official purposes outside of the UK. Apostilles are most often required for work, business, legal issues and personal matters such as marriages, births, property and business transactions. At Riley Hayes Solicitors we are able to provide a full apostille service, for both urgent and non urgent documents.
