Accidents at Work and School

Your Employer has a legal responsibility to look out for your health, safety and welfare while you are at work.

Some examples of the causes of the injuries at work are ; slips, trips, falls from height, machinery, exposure to chemicals, being hit by something, and repetitive movements.

Also, every year thousands of employees develop work related illnesses. If you have a work related illness caused by your employers negligence then you have the right to claim compensation which can help ease your suffering and help restore your former quality of life. For example; you may only have 2 years in which to start Court Proceedings for compensation if you are injured on a ship or an aeroplane.

Also, there are different rules if you have booked your holiday as a Package Holiday, as opposed to booking the travel and accommodation separately.

Slips and Trips

These are sometimes known as Public Liability Claims, and can include injury sustained in Shops and on Council Property, as well as on other premises and it may be that you are entitled to compensation for your injury if the owner or occupier of the premises is in breach of their statutory duty or has been negligent.

When we receive your enquiry we will assess the initial information you gave us and contact you to discuss your claim in more detail.

We are transparent about costs and usually offer a ‘No Win No Fee’ arrangement to fund your case. This means that if you win your case you will have to pay us our fees and disbursements ( such as the cost of an Insurance Premium if you take out Legal Expenses Insurance to protect yourself ).

However, if you win then we recover the majority of the legal costs from your Opponent or their Insurers. Although there is often a deduction from your compensation which is capped so that the maximum amount that can be taken from any compensation awarded to you and put towards payment of your legal costs, is 25%.

If you lose your claim you usually do not have to pay anything, including not having to pay for disbursements.

Compensation for the pain and suffering that you have experienced, and any future pain and suffering.

Compensation for medical costs, rehabilitation and physiotherapy that you may need or have already paid for.

Compensation for any loss of earnings that you have had, future loss of income that you would have earned, and any past or future financial losses or expenses caused directly by your injury.

The length of time to conclude a claim varies from case to case depending on a number of factors which we may not have control of.

We have concluded cases within 6 months if claims are straight forward, the other side have admitted responsibility quickly, and the injury was not very serious. Other cases have been resolved within 12 months and some can take a number of years to conclude if they are for very seriously injured claimants or involve very complicated legal issues, or the Opponent denies fault and the case has to be taken through Court Proceedings.

We may be able to persuade your Opponent to pay for the costs of any rehabilitation and support you may need, or to arrange that rehabilitation and support ourselves and to claim the costs back through your claim.
